How to file a complaint with agent who practice discrimination?

I recently submitted a full price offer shortly after the house on the market (922 w Forest dr. 77079) but felt the listing agent is extremely unprofessional and would not release all documents, nor answering any emails or phone calls. My agent even went to the open house to meet with her in person but was treated poorly. After waiting for two days, the agent simply told us No. Why can file a complaint against agent who practice discrimination?

So sorry to learn of your frustrating and troubling encounter with an unprofessional licensee!

True, it is your right to file a complaint. Within the complaint process there is a section on the form where the complaintant states and documents which law or code of ethics has been violated. It is important to be specific in this as an incomplete or vague complaint seldom results in your satisfaction.

To help you with this the Texas Association of Realtors has an "Ombudsman Program" where consumers can speak with someone who can help them to clear up the misunderstanding, or if a violation has occurred, step the consumer through the complaint process.

First let me say I'm sorry you had a bad experience. It has turned into a sellers market and many times there are multiple offers on a property as soon as it's listed. The seller can accept whichever offer they choose as long as it does not violate a fair housing law. Many mutiple offer properties go well over list price. Even if the offers are for the same price, they may choose an offer that has stronger financing, an earlier closing date, shorter option period, cash over financing...the list can go on. It's possible that the agent had a better offer already. The listing agent is not able to share information about other offers. She would be violating her fiduciary duty to her seller/client if she did so. Unfortunately in multiple offer situations, only the one buyer that has their offer accepted is happy. All of the other buyers are upset. If there is some reason that you have not mentioned here that you feel like you were discriminated against based on fair housing laws, you can file a complaint with TREC. I hope you next offer is successful!

Regretfully you've had a bad experience. My guess is your agent called the listing agents broker to complain? Did your agent try to verify that the offer was submitted to the seller? I would start with your agent. If your agent feels as you do that there was discrimination involved they will know how to proceed in filing the complaint. Now, if your agent doesn't want to file the complaint and you still feel you must, you can contact your agents broker. If you aren't satisfied with the way the broker handles your complaint you can contact Texas Real Estate Commission (TREC)

From the information you provided, it doesn't seem like you have anything to complain to TREC about. But you can file a complaint with the listing agent's broker for unprofessional behavior.

You did not give us all the facts, did you make a full price offer or did you try to lowball the seller. A lot of the times sellers will not respond to an offer that they consider insulting. I always advise my sellers to respond with something even when it is the list price. It might have nothing to do with race. It might have something to do with your Realtor and that Realtor a history. I don't think a Realtor would be foolish enough to be racist when they received an offer from someone. That could cost someone their livelihood so why would they do that .Robert gave you TREC complaints info. The only documents that they had to provide for you and your Realtor by the way was the Seller's disclosure which is online. Anything else was your Realtor's job.
