If you have an exclusive agreement, the seller shouldnt work with both you and a wholesaler simultaneouslythat can cause conflicts. Also, listing a property above market value to mislead buyers isnt ethical and could cause legal issues. Make sure all roles and fees are clear and follow your contract.

Always smart to dive into these prices first with Condos and keep your buyer aware, cause they can sometimes be significant. Hope this helps!

I have a client under contract. The survey came back before closing with a shortage of approximately 2500-3000 ft due to a fence encroachment on a 3 acres tract. The neighboring owners (Estate) with the encroaching fence are refusing to move it. The property appraised slightly over. I know we can terminate, but seek alternative resolutions/options before presenting to my client.

Catherine! Great question, sticky situation! This is one of those situations where your clients would want to ideally consult with a real estate attorney before moving forward with anything. However, it is totally up to them if they would like to move forward or not in general. Your only obligation is to point out the encroachment. The current seller can definitely approach the neighbor to see if they are willing to move the fence, or at least if they are okay with it being moved for them to the proper spot! From there, if the neighbors move it great, or if they dont care if it is moved, either the current seller can move it, or the new buyer can move it! Best of luck on that situation!
