I had a lease listing in December in which I sent all tenant information to the owner/landlord for screening. The tenant quit paying rent and did damage to the property. He had to evict her. The tenant was unrepresented. Now he is trying to ask me for my comission back. Can he do this? Where do I stand?

Hey Rebecca, Great Question and I'm sorry you've been put in this predicament. The short answer is No, they can't ask for commission back. You earned your commission when you found him a tenant and provided him with all the screening information. It was ultimately the management company or landlord who made the final decision on the acceptance of a tenant. So, as Realtors, we cannot be held accountable for the actions of the tenant. Hi everyone,\n\nCan someone apply for a withholding certificate for foreign investors (Form 8288-B) for the sale of their property if it is their primary residence and they do not have a SSN, only a TIN? Profit from the sale is under $250,000 and they\'ve lived there over 2 years.

Form 8288 deals with tax withholdings on dispositions by foreign persons of US Real property interests. The IRS defines a foreign person as a nonresident alien. If the \"foreign person\" has been physically resident in the home being sold since you say its their primary residence, then its questionable if they are really foreign persons from the lens of the IRS. Even without a green card or SSN, if a person meets the substantial presence test, the IRS will not consider them as foreign persons for tax purposes and the withholding will not be required. If however, the person(s) are determined to be foreign persons by the IRS definition, no withholding is required if the realized (sales) value of the residence is $300k or less. If the realized value of the home is $301k - $1m, withholding is required at a reduced rate of 10%. Please consult a tax specialist to help determine the correct IRS application for the specific situation.

Hey Edward! Great question! I used a binder in the beginning, but it seemed outdated and cumbersome, so I just kind of used an imaginary binder to guide me through the consultation a few times, and I really did not like that. So several years ago I switched to a PowerPoint presentation that I use. It seems so much more professional. I can run it on my iPad or laptop, I can skip slides here and there, stop to answer questions where I need to, ask my questions for the clients, etc. It just keeps the whole process more streamlined and professional. We get through everything we need to get through, all questions are answered, and the conversion rate is excellent. I have tweaked it a lot over the years and now use it for my home buyer seminars too. I started with a free template from Slidesgo and built out my presentation from there. I basically just walk them through the process, start to finish, from financing all the way through the process to the clear to close. I ask for feedback every time and it is always overwhelmingly positive. Building it from scratch is the hardest part, and then you can tweak it along the way based on feedback. I have one for sellers too! Hope this helps!

Where can find the form of Notice to a Purchaser of Real Property in a Water Distric

Hi Carina! According to state law, MUDs are required to post the Notice to Purchaser on their website, and it is my understanding that they are supposed to post it no more than ONE click away from their homepage. However, if you have ever tried to find one, 9 times out of 10 that is not the case. I usually have to dig and dig to find it. I love that one time out of 10 when it actually is one click away, or even better when it is right on the MUD homepage! Below is my favorite resource for finding information about MUDs. Just click on the link, type in the address, and then click on the red outline of the MUD and it should take you to their homepage. From the MUDs homepage, try to find the Notice to Purchaser. Where can I find a 55+ community

Hi Polet! To do a search for 55+ communities, either for active listings or sold comps, or any other status you need, go to the Matrix, click SEARCH and select the property type you want to search for. I usually use the QUICK SEARCH option. When the search screen appears, scroll all the way down to the bottom where it says ADDITIONAL FIELDS ADD REMOVE. Click on ADD REMOVE and a list of hundreds of different search criteria will appear. Scroll down and select ACTIVE COMMUNITY 55 YN and click ADD to your selected fields. Then go BACK to your search screen and scroll down to the bottom and click YES. Then scroll back up and run your search criteria and they should all be 55+ properties. Hope this helps!
