When a tenant is going into the Military and is in a lease with a few months still left on the lease before the departure date. Will the tenant still have to pay the remaining on the lease? If they have to show proof of departure, what should the tenant show? Thank you in advance.

Under both federal law (Servicemembers Civil Relief Act SCRA) and Texas Property Code 92.017, service members are legally entitled to terminate their lease early without penalty under certain conditions. This applies across the state of Texas and is something we, as landlords and property managers, must honor.Heres what to expect:1. Requirements for Lease Termination: To legally break the lease, your tenant must:Be entering active duty military service (or already be in active duty and receiving PCS or deployment orders for 90+ days),Provide written notice of intent to terminate,Provide a copy of their official military orders (or a letter from their commanding officer if orders are pending).2. Effective Date of Lease Termination: Once proper notice and documentation are received, the lease will officially terminate 30 days after the next rent due date. For example, if they deliver notice on April 10th and rent is due May 1st, the lease would terminate on May 31st.3. Rent & Security Deposit:The tenant is responsible only for rent up to the termination date.Any rent paid beyond that must be refunded within 30 days.The security deposit may still be retained or partially retained for damages (outside of normal wear and tear), just like with any other move-out.4. Best Practice: I recommend accepting their written notice and verifying the authenticity of the orders. For documentation and your protection, ask the tenant to send the paperwork via email or certified mail and keep a copy on file.

Agent, C. Galloway used a picture from a listing I had and copied also the wording in physical description until I discovered it 9 days later. I asked her to pay for the photo on the same day that I filed a complaint with HAR. She refused to pay for it an said I will take it down and immediately took it down, before HAR saw it. What could I have done to get her to pay for the 9 days she had it on her listing.

Before filing any complaint, be it to HAR or even TREC, you need to have actual proof of the complaint. In this case scenario, it would have been wise to have the original listing copied in picture and PDF format, which was in your name, AND the same for the new listing, which was under the other agent's name. This way, you can prove by the date of each listing who posted first and see that everything was copied. The agent would then be in violation not only for using your pictures but also for plagiarism for using the exact same text description, both of which are ethics violations. Hope this helps

Marquita! Great question! Here's an answer that nobody wants to hear, but is the ONE and ONLY truth: The best lead generating system is the one or ones you actually commit to. The one you are CONSISTENT with every single day (at least M-F) and continually improve upon. If you're going to door knock, then do the same amount of doors per day and practice your scripting. Same with cold calls. If you're going to farm, remember this is the long game, and plan for results to begin to trickle in within the 6 month to 12 month mark. The issue is that agents don't time block, stay consistent, and continue to improve. They just say "oh well this sucks and it's not working" after 2 weeks of inconsistent efforts. I am representing a buyer who is working with cash but has certain guidelines. She is putting in an offer with cash and is giving the seller the asking price but is contingent on the appraisal coming back for that price. Addendum Concerning Right to Terminate Due to Lenders Appraisal states to use this form only if using third party financing addendum, so can I put it in special provisions?

To answer the question of can you put this in special provisions, may be an opportunity for you to certainly discuss this with your broker and or legal. As far as the purchaser having certain conditions that must be met and prior to the purchase, indeed I agree with a few of the other responses in that a longer option period may be the best option for these conditions to be clear before having this purchaser bound to a contract awaiting an appraisal. If the purchasers conditions are based on items such as a roof or other factors that may somewhat affect the outcome of an appraisal, then these items should be taken into account with the option period and inspections and comparables and the bottom line price of what that purchaser is willing to pay if these conditions are not met.

Two lots were showing on the survey but on the contract only one lot was in legal description. Lots have been sold. Now a contract needs to be written for the other lot that was not on the contract legal description and Title company said to use appraisal district value so how is that written to pay for the Title Policy closing fees only because the lot has been purchased?

Its very complicated, I think you can ask your Broker about Survey, But there is no Price there is no contract. need always Value in exchange. There is no contract as I think.

I represented Seller in a transaction where the buyer decided not to close on day of closing but will not release the earnest money to the seller. How does the seller go about filing mediation?

I would start with submitting the termination and release documentation both to the seller and to the title company. In general, the dispute is between the two parties, and according to the contract mediation should be the option to resolve this. So your buyer may need to choose a mediation company and the seller should be properly notified of this. Then as an active realtor, if the above doesn\'t work, you can call the TAR legal hotline and speak with a real estate attorney for no additional charge. I hope this helps you and your client.

My buyer bought a property that was previously flooded but was remodeled

The buyer's agent should make sure the property has been remediated and had the part of the walls that had water damage removed so that mold will not continue to grow. First check to see how many times it has flooded because you do not want to purchase in an area that has a risk of floods. Buyers should always check with their insurance agent and they can let them know about flooding on that property or in that area because it could affect their insurance. Always do due diligence.

Its my first time working on the Listing side of a Rental property transaction. I want to make sure I'm servicing my client and need a little assistance. Does anyone want to share their process on how they help rental listing clients on the Homeowner/listing side? I will be happy to inform you of my process; however, always get with your Broker. 1. Create a CMA to price it correctly. 2. Prepare all your docs such as the Listing Agreement, HOA, MUD, LBPA (if built before 1978), Seller's Disclosure Notice. 3. If owners owe or have a lien ask them to request payoff. 4. Ask owners what Title Company they will want to use. 5. Take photos. 6. Enter in MLS. That is my process, but get with your broker to make sure all docs are filled out correctly.

Hi, I have been using American Apartment Owners Association for at least the past 3-4 years. The tenant pays for the report and it gives the agent credit score info, background check and evictions. Hope that helps you.
