The Texas Commitment for Title Insurance
Yesterday I attended a seminar that included an excellent presentation of information on
understanding the Texas Title Insurance Commitment.
The presenter was Ms. Janet Minke, VP of Underwriting Support Services at Alliant National Title
Company. Ms. Minke has been in the title insurance industry since 1970 and definitely knows
her stuff. I was especially impressed with her ability to make her info output easy to keep up with
and at the same time she related how important it is to READ the commitment when the title company
sends it out.
Many people involved in real estate transactions from Realtors, lenders, sellers, buyers, etc. do not
take the time to read through this important paperwork, and therefore may end up at or near closing
the transaction with problems or challenges that could have been resolved earlier in the process.
Do you read the title commitment when you receive it? I am interested in hearing about how
many people are paying attention in this particular area of the real estate transaction. Have you
had last minute problems with other parties to your transactions because the title commitment
info was overlooked? Let me hear about that and how it worked out, or if the process was delayed
due to this issue.
Some of the items covered included the title company's role, the land covered by title search,
what estate or interest is covered, who owns the interest in the land, liens, encumbrances, any defects, etc. Also covered were schedules A, B, C and D. She discussed surveys, divorces, inherited property, warranty deeds, and much more.
